摘要
城市房屋拆迁涉及政府、被拆迁人以及开发商的利益,是一种相当复杂的利益博弈行为。从目前实际情况看,被拆迁人绝大多数是普通的城市居民,在拆迁过程中,他们处于弱势地位,其合法权益被侵犯后寻求救济艰难。究其原因,主要是行政裁决、行政复议、信访等救济渠道不畅。为了维护被拆迁人的合法权益,必须畅通其救济途径,特别是法律救济途径。
Being related to the interest of the government, the dismantled, and the developer, city house dismantlement is a rather complicated activity of interest war. According to the present situation, most of the dismantled are ordinary residents who are in an inferior position in this process; what＇s more, it is difficult for them to get any assistance when their legal interests are infringed. The main reason of this situation is the inadequacy of the assisting system for administrative arbitration, administrative re--arbitration, litigation, and appeal. To protect the legal rights of the dismantled, it is a must to clear the ways of assisting, particularly the legal ways of assisting.
