摘要
行刑社会化是当今世界行刑制度发展的显著趋势,反映了由重趋缓的刑罚观念的价值取向,也是现代刑罚立法由严到宽的必然归结。如何界定行刑社会化的概念,确立其理论基础,此中涉及刑法学、社会学、刑罚学、监狱学等诸多领域。在全面考察国外行刑社会化制度的基础上,进而合理构建我国的行刑理念,探索有中国特色的行刑社会化制度,已成为行刑研究领域的重要理论课题。
Execution socialization remains the remarkable trend of current development of execution of the world, and reflects the ＂from severity to liberal＂ valuable orientation of penalty idea, which also is the inevitable conclusion of the modern penalty legislation. How to limit its concept and establish its rationale involves many domains such as the criminal law, the sociology, the penalty, and the jail. Reasonably constructing our country＇s execution idea on the foundation of checking overseas system concerned, exploring a system with Chinese characteristic has already became the theory topic in this field.
