摘要
《与贸易有关的知识产权协议》(简称TRIPs协议)是目前保护地理标识的最新国际公约。WTO各成员国对地理标识进行扩大保护存在争议。作为一种集体权利的地理标识应给予强保护,从现实意义来说,对地理标识的扩大保护能体现广大发展中国家的利益。我国在地理标识的WTO新一轮谈判中,在主张对地理标识扩大保护的原则上,应坚持以利益均衡化为目标,满足多方需要。
The TRIPs Agreement is the newest international treaty providing wide coverage protection for geographical indications at present. This article, starting with the introduction of the regulations about protection to geographical indications of the TRIPs, analyses the situation of the internatidnal protection of geographical indications, especially discusses membership countries' debates on the issue whether extending the higher level of protection beyond wines and spirits to other products for reference to explore the rationality and practical significance of extending the higher level of protection beyond wines and spirits, in the hope of oriented role on china's tactics on negotiating whether extending the higher level of protection to other products in the new WTO negotiation.
