摘要
近年来,学术界对国家安全的界定大多仅从国际关系的视角出发,见仁见智。我国的立法也陆续将国家安全作为一个专门术语写进了相关的法律及规范性文件。国家安全作为一个法律专门术语,对其解释不应是随意的,应当从法律上作出明确的科学界定和立法解释。国家安全表征着一国宪政法律制度的正常稳定状态,是一种特殊的法律秩序。从法律上科学界定国家安全,有助于实现国家安全法制的统一性、严肃性,也有助于开展国家安全法学理论的研究。
In recent years, it has been only defined the State Security from the angle of intemational relationship mostly, and different people have different views. The legislation of our country also has written it into the related normative documents of law as a special tenn. So its interpretation should give clear scientific definition and legislative interpretation, but not freely. The State Security signs the normal and stable state of the constitutional government and law system. It is a special order of law. It can help to realize the unity and the stemity of the State Security legality, to promote the research of the State Security jurisprudence theory to define the State Security scientifically from the angle of law.
