摘要
为了履行TR IPS赋予W TO成员国的义务,我国入世后加强了地理标志的法律保护。但与TR IPS标准相比,我国对地理标志的保护力度不够,有必要研究TR IPS协议相关条文以及W TO新一轮关于地理标志多边谈判的最新发展,结合我国地理标志的保护现状,参照其他国家的立法模式,进一步完善我国保护地理标志的法律,使我国地理标志能得到成员国充分有效的保护,以促进我国经济尤其是农业经济和特色经济的发展。
In order to perform the obligations imposed on WTO members by TRIPS, after joining WTO, China has taken various measures to provide better protection for geographical indications （GIs）. However, compared with the TRIPS standards ,our legal protection for GIs is inadequate. So it＇s necessary for us to study relevant TRIPS provisions and important developments in current negotiations concerning GIs. Based on this, we should improve our legal protection for GIs by finding out the defects in our current legislation and adopting the experience of other legislation so that our GIs can be well and adequately protected in other Member States. As a result, our economy, especially agriculture and special economy will develop faster and more healthily.
