摘要
农地承包权①转让经发包方同意的限制是必要的和可行的,此外,物权法还应规定本集体经济组织成员在同等条件下有优先受让权,但受让方的范围不宜限定在本集体经济组织内部;农地承包权的出租后,承租人所取得的权利是物权化了的债权,其租期的限制应当符合《合同法》的有关规定;物权法草案(四次审议稿)允许农地承包权有条件的抵押是对现行立法的重大突破,是切实可行的,其抵押权的实现方式有其特殊性和灵活性;设计农地承包权的继承制度既要充分考虑我国农村的现实,又要保持相关法律之间的协调。
The limit is necessary and feasible that the assignment of Rural Land Contractual Management Rights should be agreed by collective economy organization. In addition, the property law also should provide that the members of collective economy organization have priority right under the same condition, but it is not suitably that the scope of recipient is confined to the members of collective economy organization. After the rental of Rural Land Contractual Management Rights, the right which the tenant obtains is a kind of property right from creditor's right, and the limit of its lease must conform to the provision in contract law. It is significant breakthrough to the present legislation, practical and feasible that the fourth Real Right Law Draft allows Rural Land Contractual Management Rights to mortgage, but the realization way of mortgage has its particularity and the flexibility. To design the system on the inheritance of Rural Land Contractual Management Rights must consider the reality of countryside of our country fully, and maintain the coordination between the correlation laws.
