摘要
新闻自由是一种有限度的自由,在遇到战争、国家机密、公共利益及新闻报道缺乏社会责任等情况下,新闻自由将受到约束。从哲学维度探讨新闻自由的限制性权利从无到有的发展过程。从最初的天赋观到法律框架下的自由观,再到社会责任论下的自由观,新闻自由的限制性权利不断被充实,更加符合社会发展的要求。新闻自由的限制性权利表明,新闻自由权利不可滥用,不仅要受到法律限制,还要符合社会公共利益和社会道德的要求。
News freedom is a kind of limited freedom. Under the situation of war, state secrets, and public interest, and with the lack of social responsibility, news freedom will be bound. From the angle of philosophy, the article discusses the restrictive right-evolution of news freedom from naught to its formation, from the original idea of God-bestowed right to the free idea in law structure and to the free idea under social responsibility. The paper finds that the restricted rights of news freedom is continuously enriched but accords to the requirement of social development. The restrictive right indicates that the free right should not be abused and it should not only be under the confinement of the law, but also accord to the requirement of social public interests and social and moral standard.
