摘要
我国天然气行业由于长期缺乏以市场化原则为基础的、完整统一的法律框架,其可持续发展受到制约,制定专门的天然气法势在必行。国外天然气立法经验表明:各国天然气法律规制都经历了从严格管制、放松管制到最终鼓励竞争的过程;独立监管是各国天然气行业普遍遵循的原则,具体包括管理部门与监管部门的分立、监管部门的官员独立客观地行使职权以及经费独立;对天然气立法普遍持谨慎稳妥的态度等。我国天然气立法应当借鉴国际经验,将促进天然气市场竞争作为一项基本原则,循序渐进地建立面向竞争的天然气市场环境和相对独立的天然气监管体制。
Lack of a market-oriented, complete and integrated legal system on natural gas impedes the development of China’s natural gas industry. It is imperative to make a special natural gas law. Legislation practices in foreign contries show that: Natural Gas Legislation in each country has been gone through a progress from strict control to deregulation, and eventually established a competition encouraging strategy; Independent supervision is a principle generally adopted by foreign countries, which mainly includes establishing management department and supervision agency separately, keeping the independence of jurisdiction and cost control of surveillance agency; holding precaution and prudent attitude to Legislation of Natural Gas Management. Learning from international experiences, China should gradually establish the market-oriented natural gas market and relatively independent gas supervision system with promoting competition in the natural gas market as a fundamental principle of legislation work.
