摘要
为考证"海商法"名词之由来,运用文献考证、分析以及合理推测与举例的研究方法,对西语及中文"海商法"一词的起源与流变进行梳理,从而得出中西"海商法"名词有着密切的渊源关系,并有共同的鼻祖——拉丁语"Mare"一词的结论,从而进一步认同法律发展论的观点。
In order to study the etymology of ＂maritime law＂, this article used the study methods of textual research and analysis, reasonable conjecture, giving examples and so on to card the origination and development of the western word and Chinese word ＂maritime law＂. So, the conclusion is that the western word and Chinese word ＂Maritime Law＂ have a tight original relationship between each other, and they also have a common origin-the Latin word ＂Mare＂. Based on that, the author agrees to the view of legal development theory.
