摘要
根据某篇土地卖契的地权之名与地权之实,主要是地权之实得出地权转移的语义结论,称之为单篇解读。把原始白契看作单篇,根据原始白契、乡政府鉴证草契、县政府颁发赤契和契税过户注销土地证所组成的契约系统得出地权转移的语义结论,称之为系统解读。系统解读的语义结论能反映地权转移的真实历史。因此,当单篇解读与系统解读的语义结论不一致时,应把系统解读的语义结论视为地权转移的历史结论。并非每个单篇解读的语义结论皆能反映地权转移的真实历史,因此把单篇解读的语义结论视为地权转移的历史结论,应采取谨慎态度。
Single Interpretation refers to the semantic conclusion of land-ownership transfer based on the nominal and real land-ownership, especially the real one. Systematic interpretation refers to the semantic conclusion of land-ownership transfer based on the contract system consisting of original blank contract, draft contract, red contract and cancellation of land certificate due to transfer ownership. The semantic conclusion of systematic interpretation can reflect the real history of land-ownership transfer. So when the semantic conclusion of single interpretation and that of systematic interpretation are inconsistent, the latter should be regarded as historical conclusion of land-ownership transfer. Not all the semantic conclusion of single Interpretation can reflect the real history of land-ownership transfer, and a cautious attitude should be adopted in taking the semantic conclusion of single Interpretation as historical conclusion of land-owner- ship transfer.
