摘要
本文认为,现代物流是一个高度系统化、综合化的行业,只有从系统的角度出发加强物流立法,才能充分发挥整个物流系统的高效率。为促进我国现代物流业的健康发展,文章提出,必须合理构建物流法律框架(主要包括物流基本法、宏观调控法、物流主体法、物流客体法、物流环境法及符合物流活动特点的物流标准),建立健全适应物流业发展需要、符合市场经济规律、与国际通行规则接轨的物流法律体系,促进物流市场体系的形成和完善,为物流市场的发展创造良好的软环境。我国的物流立法必须尊重传统法学理论,切合物流行业发展特点,体现本土化特点,着重理顺现有单行法之间的层次结构与逻辑脉络。物流法律体系基本框架应该是开放和动态的,并能根据实际情况进行调整和完善,从而为建设统一、开放、公平竞争、规范有序的现代物流市场体系创造良好的法律环境。
Along with the constant .development of the logistics industry in China, people pay more attention to the basis for the development of modem logistics environment, particularly the legal environment .The authors start from analysis On the state and the problem of the building for the logistics legal ,combining China＇s specific condition, building a Logistics legal system suited to our socialist market economy system ,thereby promoting a healthy development of China＇s modem Logistics industry.
