摘要
普遍认为,造成我国煤、气矿业权争议的原因是现行的矿业权分置制度,实际上只要充分发挥市场在资源配置中的作用矿业权也是可以分置的。因此,真正需要采取的措施不是统一煤、气矿业权的行使主体或是统一发证机构,而是需要一方面肯定市场在资源配置中的基础作用,另一方面借助政府的力量消除市场运行的障碍。
The normal viewpoint believes the disputes between coal and coalbed methane are due to the current separation institution of mining right. However, it is impossible to be separated only if the market can exert itself in distribution of resources. So the required measurements are not to unify obliges or organs, but on one hand to affirm the basic influence of market in distribution of resources to eliminate the obstacles for the market by government on the other hand.
