摘要
美国违宪审查制度的建立和运行有深刻而独特的政治、文化和社会背景。美国宪法确立的"三权分立"政治体制及三权制衡原则为违宪审查制度提供了政治保障,法官享有的社会威望和民众对法律的信心奠定了法治基础。通过运用违宪审查权,普通法院不仅达到了制约立法权和行政权的目的,而且实现了司法权对立法权与行政权的横向平衡和中央与地方的纵向平衡功能。
The Constitutional Review System of the United States is tounded on the particular political, civmzauon and social backgrounds. American Constitution sets up the political system of separation of the three powers which balance effectively. This political system provides political protection for The Constitutional Review System. And the legal basis is that Amerieans highly respect and believe in the judges. The judicial power not only checks the legislative power but also balances the different jurisdictions between the federal government and each state.
