摘要
目的:探讨精神病人纵火行为的犯罪学特征及刑事责任能力评定的特点。方法:对经司法精神医学鉴定的涉及纵火案件的61例精神病人的一般资料、作案特点、医学诊断及刑事责任能力等进行回顾性分析、总结。结论:应建立健全对精神病人的三级防治网络,尤其应重视加强对农村和中青年精神病人的治疗、监护工作,以最大限度地减少精神病人纵火等案件发生。司法精神医学鉴定文书作为一种法律证明,其重要性自不待言,鉴定工作必须慎之又慎。
Objective To explore criminological characteristics of the arsonous psychotic and assessment of their criminal responsibility. Method A review analysis and summarization are conducted of the general data, criminal characteristics, medical diagnoses, and criminal responsibility of 61 psychotics involved in arson identified by judicial psychological medicine. Results It is found that psychotics are mainly young males in the 61 cases （85.2%）, most of them are young male peasants with education from junior middle schools or lower levels or unemployed people, 63.9% of the study group are schizophrenics, 16.4% with mental retardation, and 43 （70.5%） cases have no criminal responsibility, and 14 （24.65%） cases have partial criminal responsibility. Conclusions We should establish and complete three grades of networks of prevention and treatment of psychoses, especially strengthen the treatment and custody of the young male psychotics in the countryside, and try our best to reduce the occurrence of arson. It is self-evident that identification files by judicial psychological medicine are of extreme importance as legal certificates. We should take great care.
