摘要
"无为而治"是中国传统社会的治国理念。中国古代民间纠纷解决的基本范式以民间调解为主要手段,以民间习惯为主要依据,以追求"无讼"为价值理想。"无为而治"理念对传统民间纠纷解决范式具有重大影响。在"无为而治"理念的引导下,国家司法权在民间实行"无为",主要运用调解方式,充分重视民间习惯,化解民间纠纷,最终达到"无为而治"的治理效果。社会和谐的价值考量、熟人社会的情理需要、调查取证难的客观要求等,是"无为而治"理念渗透民间纠纷解决范式的原因所在。
Governing by noninterference is an ideal ruling strategy for the Chinese traditional society.The basic paradigm of resolving civil disputes in ancient China is mainly based on folk customs,using civil mediation as its main method,and pursuing the value ideal of non-litigation.Governing by noninterference has great impact on the basic paradigm of resolving civil disputes in ancient China.Under the guidance of it,the the national judicial power does not interfere in civil affairs,but only applies the means of mediation,putting emphasis on folk customs,trying to reslove civil disputes.There are several reasons why the idea of ＂governing by noninterference＂ has deeply affected the paradigm of resloving civil disputes,such as the value consideration of harmony in society,etc.
