摘要
"党的领导、人民当家作主和依法治国的有机统一"是由党的十五大正式确定,党的十六大、十七大再次重申和阐释的治国理政的根本原则。"党的领导、人民当家作主和依法治国的有机统一"其科学内涵极为丰富,可以概括为三个方面:第一,党的领导是"三者统一"的根本保证;第二,人民当家作主是"三者统一"的本质要求,是坚持党的领导和实施依法治国的价值目标;第三,依法治国是"三者统一"的根本手段和重要保障。坚持和完善"三者统一"必须坚持和完善三大基础:"三者统一"的思想基础:社会主义法治理念;"三者统一"的价值基础:以人为本;"三者统一"的制度基础:人民代表大会制度。
It is the fundamental principle of administering country that the organic unity of The party＇s leadership, the people being the masters, the rule by law, which was formally confirmed on the Party＇s 15th Congress,and refirmed again and interpreted systematically on the Party＇s 16th Congress and 17th Congress. The scientific connotation of this fundamental principle is extremely abundant and are summarized as follows ：（1） the Party＇s leadership is the fundamental Guarantee of the organic unity;（2） people＇s democracy is the essential requirement of the organic unity and is value goal of The partyg leadership and the rule of law;（3） tale by law is fundamental means and important guarantee of the organic unity. Insisting and perfecting the organic unity of the Party＇s leadership, the people＇s democracy and the rule of law must insist and perfect the Three Bases which are： the Ideological Basis—socialist idea of rule by law,the value foundation—people oriented, and system foundation—people＇s congress system.
