摘要
于2009年2月28日最新出台的《中华人民共和国食品安全法》第五十一条对保健食品进行了严格界定,规定保健食品不得涉及疾病预防功能。作者就我国以往保健食品立法的研究系统,保健食品的定义及其主要内涵进行深入分析,并就保健食品是否应排除疾病预防这一问题进行讨论。
In the latest＇ Food Safety Law of the People＇s Republic of China＇ , item 51 has strictly defined health food products,prescribing that health food should not involve the function of disease prevention. After a systematic study of previous Chinag legislation of health food products and a deep analysis of the main connotation of the products, the issue whether the function of disease prevention of health food products should be excluded or not will be discussed below.
