摘要
农村集体建设用地流转中存在的问题容易滋生土地纠纷及权力寻租。农村集体建设用地流转制度安排和创新"牵一发而动全身",需要一整套的支撑体系保障。法制支撑体系是农村建设用地有序流转的重要环节,权益机制支撑体系是保证农村集体建设用地高效流转的关键,外部环境支撑体系是集体建设用地顺利流转的基本条件,配套制度支撑体系是农村集体建设用地流转必不可少的环节。
Among China＇s current circulation of rural collective construction land, there are many problems and difficulties, which could easily intend to be land disputes and the rent-seeking right. The systematic arrangement and innovation of the rural collective construction land circulation just ＂pulls a hair to disturb the situation as a whole＂, involving all aspects and needing a set of safeguards of the support system. Therefore, a legal support system is needed as an important part for a solid legal guarantee for its orderly flow of rural land used for construction; a rights-mechanism support system works as a key in ensuring efficient transfer; the external environment support system is a basic condition for the smooth transfer of collective land for construction; and supporting systems are essen- tial component for rural collective construction land transfer.
