摘要
滑稽模仿保护了言论的自由,早期出现在版权法领域内,但在现实中,商标的滑稽模仿的现象却比较常见。商标滑稽模仿通常被视为商标合理使用的情形之一,从而成为商标侵权抗辩的重要事由。随着商标功能的不断扩大,从单一的区别、指示功能发展到代表商标背后的个性或企业的人格,成为企业商誉的载体。因此,这种滑稽模仿是否能够作为侵权抗辩的绝对理由,有其一定的判断标准,应该从滑稽模仿与混淆可能性以及滑稽模仿与商标淡化的角度加以思考审查。
Parody, protecting freedom of speech, first appeared in the realm of the copyright law. Actually trademark parody can be found quite common. Often regarded as a reasonable trademark use, it is an important subject of trademark infringement defense. The expansion of trademark functions has made it an indicator of businesses' credibility, which not only has distinguishing and indicative functions but also is an embodiment of enterprises. Therefore, there should be some criteria by which to judge whether parody can be an absolute defense. Studies on it must be made in terms of the relationship between parody and confusion possibilities, and the relationship between parody and trademark dilution
