摘要
作为法学教育方法,法教义学是每一位研习法律的人养成法律实践能力必须掌握的方法;作为一门法学科,法教义学以实在法作为其工作对象,以解释与体系化为其工作任务;作为建构法秩序的技术性手段,法教义学发挥着法的简明化、安定化等功能。这三个方面均鲜明地体现了法教义学直面法律实践的品性。对于作为实践理性的法学而言,法教义学以其独特的品格在法学中无疑应居于主轴性地位。
As an educational approach, dogmatics of law is an approach that everyone studying and practicing law must have a good command of. As a branch of law science, the main task of dogmatics of law, with law as its working object, is to interpret and systemize law. As a technical means to build order of law, dogmatics of law performs the role of simplification and stabilization of law. The above-mentioned characters clearly demonstrate the nature of dogmatics of law; therefore, dogmatics of law should occupy the backbone position in the law science with its unique character.
