摘要
《中华人民共和国侵权责任法》的施行可能缓解当前紧张的医患关系,文章通过阐述侵权责任法中有关医疗过错归责原则、举证责任以及输血相关产品责任等内容,对侵权责任法相关条款的适用提出了自己的见解,对相关条款的不同理解也做了合理的分析。
The implementation of Tort Liability Law of the PRC may alleviate the current intense doctorpatient relationship.The article elaborated medical malpractice liability,onus probandi and product liability of blood transfusion,put forward some opinions in the application of relevant clauses of Tort Liability Law,and made some rational analysis of different understanding of relevant clauses.
