摘要
近年来,随着预售商品房交易量的上升,预售商品房广告方面的纠纷也在增多。要依法严格规定广告宣传的内容,将广告内容定位为"最低义务",对广告主采取过错推定责任原则,加大对虚假广告的惩处力度,从而更加有效地保护购房者的合法权益,促使预售商品房广告在规范中健康发展。
In recent years, with the increasing sale of the commodity apartment sells in advance, the advertisement disputes also increased. This paper supplies some ideas about risk prevention by studying the legal nature and content of commercial housing pre-sale advertising: To give strict regulations in the content of advertising, and to consider the content as a " minimum obligation" for advertisers, to take the responsibility of the principle of presumption of fault, to increase the punishment for false advertising efforts in order to protect the legitimate rights and interests of consumers more effectively, and to promote commodity apartment sells in advance ads in the specification and healthy development.
