摘要
监护人的权利与责任是成年监护制度的核心内容,但在我国立法上还没有全面系统的规定,需要通过完善立法,明确规定监护人对成年被监护人所享有的人身监护权、财产监护权、民事行为和民事诉讼代理权以及监护人自身所享有的获得报酬权、监护人的辞任权和拒任权,并细化监护人对被监护人的侵权责任和成年被监护人致人损害时的监护人责任。
The rights and duties of guardians are the core contents in adult guardianship system. However, the overall and systematic regulations concerning the aspect are still lacked. The legislative measures should be adopted to specify the rights enjoyed by the guardians consisting of guardianship against personal injury and property infringement towards adults under guardianship, agency in civil behaviors and civil procedural acts, remuneration rights, rights to resign from or decline to accept the position as the guardians as well as refine the duties of guardians when the adults under guardianship are infringed by the guardians themselves or when the aduhs under guardianship do harms to others.
