摘要
对行政私法行为的概念界定不同国家有着各自的识别标准,从比较的基础上界定行政私法行为概念,其性质应以公法为主,以类型化的手段具体确定公、私法属性。在行政私法行为外延认识上,由于人们常常将它与一些相近似的术语交替互换使用,混淆着行政私法行为与相关概念的关系。
Administrative private law behavior of pubhc administration in modem service concept is developing vigorously, but it＇s concepts in different countries have their own identification standard. This paper tries to define the concept of behavior in compari- son, and believes it should be pubhc law property in general. With the application of the stereotype method, it aims to determine the properties of public or private law, summarizes the types of administrative private law behavior extension and clarifies the extension of behavior of administrative private lawr.
