摘要
《刑法修正案(八)》把醉酒驾车、高速追逐竞驶(包括飙车)等危险驾驶行为入罪,已引起社会各界的广泛关注与争论。本文论述了新增危险驾驶罪的必要性、概念与构成特征及其与相关犯罪的区别,旨在为刑法修正提供参考,为司法实践提供一定的理论依据。
The author was talking about the necessity of add to the dangerous driving Crime,setting forth the concept and the constitution characteristics.At last,the author putting forward to distinguish characteristics between the dangerous driving Crime and the interrelated Crime.
