摘要
采访权是记者在采访过程中拥有的一种权利,与公众知情权、舆论监督权、表达自由等直接关联。随着媒体功能的凸显,采访权受阻、遭侵犯以及记者滥用采访权等事件频频出现,对采访权的保护、限制与规范显得非常必要。通过分析比较关于采访权法性质的不同见解,可以认为采访权是一种复合权利,对不同采访对象具有不同权利要求。
The right to gather news is a very important kind of right that a journalist has during the interviewing.It has direct correlation with the right to know,the right to supervise,the freedom of express and the freedom of press on the constitution.At present,there are more and more problems about the right to gather news,which be hampered,be infringed and abused.So,it is important and imperative thing to protecting,restricting and stipulating the right.Based on a comprehensive analysis and critics at some views on the right,we argue that the right to gather news is a kind of public right,and it is a combination of public＇s rights and civil rights.At the same time,we point out that the journalists can raise different request according to the different interviewee,especially between the public authority and the civilian.
