摘要
传统观念认为法律天生具有确定性和稳定性,而在20世纪20-30年代美国法学界兴起的法律现实主义,否定了认为法律规范具有普遍性、确定性的传统观念,对美国正统的法律观念产生巨大的冲击。美国法律现实主义对于法律的不确定性的主张,可以称之为对传统法学的一次致命性的打击。我们试图在学术脉络中凸显美国法律现实主义反确定性传统的法律观,力图揭示其所作出的学术贡献以及限于自身视角而难以逃脱的学术限度。这场"反叛性"的运动,带给我们更多的是一种批判的精神。在某种意义上,法律现实主义的消失正是它的胜利,因为法律现实主义的实际目标与任务,就是要突破人们对法律的旧有理解框架,打破已有的思维惯式。
According to traditional theories, laws are born with certainty and stability. However, this idea was negated by American legal realism movement which begun in the 1920s--30s, which has an impact on the conventional legal theories. And this paper aims to highlight the anti-certainty in legal realism from the standpoint of academic development, and tries to reveal the intellectual contribution of legal real ism as well as the academic limitation deriving from its own perspective. The anti-traditional movement brings us more critical spirit. In a sense, the disappearance of legal realism is just its victory, because the ends and tasks of legal realism are to break the old-fashioned understanding of law and the existing mind set.
