摘要
"涉法信访"是当下中国信访问题中不容回避的问题之一,是指公民、法人或其他组织就与司法相关的事项向非司法部门反映以求解决的活动,其本质是利用人治的力量去解决法治之事情。文章从对两个问题的追问上去探究"涉法信访"产生的原因,认为"涉法信访"之所以存在,其一是当前司法部门的能力不足,其二是非司法部门权力过分强大所致。
＂Petition letters about judicial justice＂ is one of the unavoidable problems in China,which refers to the lawsuit of citizens,judicial persons,and other organizations for judicial justice. The study traces the source and reason of such cases. It is believed that the reasons come from two possibilities：the incompetence of judicial institutes and over-powerfulness of non judicial institutes.
