摘要
中国古代制定有大量和环境保护相关的法律规定,蕴含着极为丰富的生态伦理思想。其中,"天人合一"、"仁民爱物"、"寡欲节用"为其内在的生态伦理基础。对其进行挖掘梳理,有助于解决现代环境法治自身理念上所存在的困境。当代中国环境法治存在的主要问题在于长期割裂法律与生态伦理的内在联系。结合传统生态伦理观,可以从环境立法、执法、守法等层面对我国的环境法治提出完善。
There are abundant valuable environmental ethics thoughts in Chinese traditional culture. They may offer insights for us into the difficulty of the concept rebuilding of the current Chinese environmental law. Based on the above mentioned understanding, his article discusses following ideas by the approach of environmental ethics： ＂unity of heaven and man＂ ,＂ the equality of the living things＂,＂ logic learned from the nature＂,＂ ascetic and thrift of not wasting natural resources＂ etc. Based on the above thoughts, the article proposes the shortcomings of the current Chinese environmental law, and offers some ideas about how to reestablish the concept of environmental law.
