摘要
市场中交易客体与作为主体的"人"之间存在各种关联,因此部分交易客体可能存在内生的不可转让性。这种不可转让性会通过道德伦理、宗教、习俗影响法律,形成了法律中对于产权和侵权保护的不可转让规则。本文分析了不可转让性和不可转让规则的内容以及相互之间的关系,并说明了背后潜在经济因素的作用。
There exist various linkages in the market between the transaction objects and the subjects, ＂people＂. Thus some of the transaction objects may have endogenous inalienability. The inalienability is affecting the law through ethics, religion and customs, and gradually forms the inalienability rule for property rights and remedies. This paper analyzes the contents of inalienability, inalienability rules and the relationship between the two. The author presents the role of the underlying economic factors in the two concepts as well.
