摘要
利用在四个基层检察院的实证调查材料,并借用社会与组织理论的概念,建构了基层检察院审查逮捕制度日常运作的理论模型。从此理论模型中,可以看到中国审查逮捕制度运作的真实情景,也能够体会到其中种种因素之间相互交错与影响的关系。此模型还提供了思考审查逮捕制度乃至整个刑事司法制度变迁的理论空间。
Based on data collected from four primary level procuratorates,this research,using some conceptions in organizational sociology,proposes theoretical models for the routine work of reviewing and approving arrest operations in primary level procuratorates.The models reflect the actual operation and complex mutual influence of various factors.The theoretical models also offer a tool for research on the procedure of ratifying detention by procuracy,or even the criminal procedure as a whole.Meanwhile,with an empirical perspective,the paper attempts to provide some reference for criminal justice research in methodology.
