摘要
司法实践中,行为人醉酒驾车肇事案件在定性和量刑上面临困境。应坚持罪刑法定原则,统一法律适用,尽量杜绝"同案不同判",以期合理评价并遏制此类案件。
In judicial practice,the determination and sentencing of traffic offense by the perpetrator＇s drunk driving are facing difficulties.We should stick to the principle of legality,uniform application of law,try to avoid ＂sentencing similar cases differently＂,and hope to reasonably evaluate and hold back such cases.
