摘要
第三人侵害债权的基本特征是:主观上,故意是原则,过失为例外;行为主体主要是债的关系以外的第三人,但在第三人与债务人恶意通谋实施旨在侵害债权人债权的行为时,债务人亦可成为共同主体;行为客体是他人的合法债权;该制度在功能和作用上只能是一种补充性的法律制度。其表现形态分为直接侵害和间接侵害两种。直接侵害债权分为:因第三人的行为直接侵害债权,致使债权丧失或实现困难的情形;第三人处分或行使债权,直接导致债权消灭的情形。间接侵害债权分为:实体侵害、引诱侵害和通谋侵害三类。
The basic characteristics of a third party torting behaviors are the details as follow： in terms of subjective, intent is principle while negligence is exception; behavior main body refers to a third party beyond the belt relationship, but when debtor colludes with a third party to infringe others debt right, he is become a co-main body; the behavior object is a valid creditor＇s right of others; in terms of fimction and effect this system is only an additional one. Its manifestations are divided into direct wrongdoings and indirect ones. Direct wrongdoings can be divided into： due to acts of the third party infringing creditor＇s rights directly, and resulting in claims loss or achieve a difficult situation; and the third party punishment or exercise creditor＇s rights, a direct result of debt elimination. Indirect wrongdoings are divided into entity against, seduce encroach and collusive encroach.
