摘要
警察权力的控制是行政法学界关注的焦点,警察裁量基准是解决警察裁量内部控制的关键因素,是连接合理行政与合法行政之间的桥梁和纽带。警察权的膨胀使得包括立法控制和司法控制在内的传统外部控制手段面临巨大的挑战,警察裁量基准制度是行政机关面对这一挑战所应用的一种自我控制制度。警察裁量权的控制研究应当从以往关注程序研究的范式转为关注实体研究的范式,将警察裁量的基准作为研究重点之一。大量警察裁量基准投入应用的同时,制定主体不明确、评估机制不健全等问题也阻碍着警察裁量基准制度的发展。完善警察裁量基准、规范警察裁量权,对于行政相对人合法权益的保护与个案正义的实现具有重要意义。
Control of the police power is the focus of attention by the administrative law scholars,the benchmark of police discretion is a key factor to solve the police discretioN internal control, is the bridge and link between the reasonable administrative and legal administration. As the expansion of police power,legislative control and judicial control,including traditional means of external control is facing enormous challenges, police discretion benchmark system for the executive to face this challenge,apply a system of self--control. Control of police discretion should be changed from the previous focus on program research paradigm to the physical study of police discretion benchmarks as one of the key. A large number of police discretionary basis, put into use at the same time, development of the subject is not clear, the assessment mechanism is not perfect also hindered the development of police discretion benchmark system. Improve the police discretionary basis regulate police discretion,for the protection of the legitimate rights and interests of the administrative counterpart case of justice to achieve significance.
