摘要
在网络时代,侦查人员必须学会"数字化生存",实现向侦查信息化的转型。这一转型应当以网络空间的洛卡德交换原理为指导,打造以电子设备或账号为纽带的双向侦查模式,实现实体侦查与数字化侦查相结合的格局,并以各种电子取证措施丰富充实侦查武器库。上述改变将突破刑事侦查的范围,在刑事司法领域产生广泛深远的影响。
In network era the detectives must learn to launch an investigation on 'Being Digital.' That is to say,criminal investigation must realize institutional innovation of informatization.Firstly,it should still follow the Locard's Exchange Principle as the guiding ideology and transfer the theory to intangible virtual space.Secondly,the investigative models should build on the bond of electronic devices or accounts,which are connected with criminal suspect at one end,and are with criminal act at other end.Thirdly,the investigative pattern should turn into a combination of criminal investigation in physical space and digital universe.Fourthly,the investigative measures should become more and more electronization.All of these changes will break through the scope of the criminal investigation,and bring great influence on the whole criminal justice system.
