摘要
著作权保护期限的变更意味着作者权利与社会公众权利的重新配置,期限的延长就是将延长时间内的权利分配给了作者。期限的延长可以实现新经济条件下的均衡,发挥著作权制度所要求的激励作用,符合资源配置所要求的效率标准,因此,期限的延长具有合理性,将期限延长的幅度界定为10年,有助于更好地平衡作者和社会公众的利益。
Changing copyright time limit means that right between the author and the public will be modulated.If time limit is prolonged,the right in extended term belongs to the author.The extended time limit can help to realize a new equilibria,promote people＇s enthusiasm and make resource be distributed more efficiently.It is reasonable to prolong the current time limit.
