摘要
人格权商品化是人格权在市场经济中的必然发展,是人文主义理念和市场经济发展相结合的产物,对人格权商品化的保护和限制实际上是人格权保护的当代重要形式,推动了人格权的发展。人格权商品化相关制度已经为很多国家的立法和法律实践所确立,但在我国尚欠系统规范。我国的人格权商品化立法在比较研究域外法律实践及模式基础上,选择、借鉴其中合理的立法经验。在未来的人格权法当中我们应就人格权商品化的保护及法律救济进行专门规定。
The commercialization of personality right is an inevitable development trend of the market economy, and the co - product of the humanism and market economy. The protection and restriction of the commercialization of personality is actually the most important form of the protection of personality right, which has promoted the development of personality right. The relevant legislation and legal practice concerning the commercialization of personality right has been established in many countries, however, which is still not systematically specified in China. China~ legislation regarding the commer- cialization of personality right may select and draw lessons from relevant foreign legislation and legal practices on the basis of comparative study. In the future of the personality right law, we shall make special provisions concerning the protection of the commercialization of personality right and its legal remedies.
