摘要 金融产品具有专业性、复杂性、无形性和风险性等特点,金融产品消费者认识上的局限性,以及信息不对称等客观原因,使得金融交易决策很大部分是受金融机构及相关经营者的推销和劝诱。赋予某些金融活动尤其是复杂金融交易活动中消费者冷静期规则,能够使消费者不蒙受因非理性的金融交易带来的巨大损失,同时也能在一定程度上促成金融交易和维持金融市场的秩序。通过学习借鉴相关的金融法制资料,分析在消费金融、理财产品等复杂金融产品交易中引入冷静期的必要性。 That Financial products have the characteristics of specialization,complexity,intangibility and risk,financial product consumers' limitation of cognition and information asymmetry and other objective reasons make the financial trade decision be mostly affected by sales promotion and persuasion of financial institutions and relevant operators.Giving some financial activities especially complex financial transactions consumers cooling off period rules can make consumers do not suffer a great loss caused by irrational financial transactions,but also can contribute to financial transactions and maintain the order of financial market to a certain extent.This paper,through the study of relevant financial and legal materials,analyzes the necessity of introducing the cooling-off period in the complex financial products as consumer finance,financial products etc.
