摘要
在法律解释方法中,为规避"同案不同判"现象,法官要正确有效地解释法律、适用法律。文义解释、体系解释、目的解释、历史解释的法律解释方法各自有其侧重点,所实现的基本价值也不同。因此,解释者必须按照它们之间的逻辑、价值或利益关系,反复权衡,不断考量,以最终选择其中某种解释方法。实践中,注重法律解释方法的位序排列有利于解决现实中的"同案不同判"问题。
In order to avoid ＂different sentence on same case＂, judges must correctly interpret and effectively apply the law. Literal interpretation, systematical interpretation, purpose-based interpretation ,and historical interpretation each have their specific focuses, and represent different basic values. When choosing one method, interpreters must take into account logical, value or beneficial relationships into account. In practice, the bit sequence arrangement is conducive to resolving the reality of ＂co different sentence＂ problem.
