摘要
"军事法"概念及其边界范围具有重要的理论和现实意义。有关"军事"与"国防"的关系无法从辞海、宪法和法律处获得清晰认识,但从党的文件、政府工作报告以及白皮书等中可以发现"国防"是与"军队"并列使用的概念。因此,"军事"是高于"国防"和"军队"的共同上位概念,军事法是由国家制定或认可,并由国家强制力保证其实施,用以调整国防和军队建设两大军事领域内各种社会关系的法律规范的总称。
＂ military law＂ is the meta - concept of military law theoretical research and military legal system construction, so the accurate definition of the professional terminology, has important theoretical and practical sig- nificance to determine the boundary. From the study of existing academic, accurately grasp the concepts of the ＂ martial law＂ concept depends on the relationship of ＂Military＂ and ＂ national defense＂ of the two. Based on the theory and practice of ＂military＂ and ＂national defense＂ two words vague understanding and sort of chaos used to i- dentify shortcomings of existing research, gives theoretical standards and practices in line with the requirements of the ＂military law＂ is defined.
