摘要
我国现行的集体土地增值收益归国家所有的制度,严重损害了农民的土地利益。现行征地制度和各级政府对土地利益的追逐,影响农民土地增值收益权的实现。要想真正实现农民的土地权利,就必须建构农民和国家分享土地增值收益权的利益共享机制,实现对集体土地增值收益权的重构。重构集体土地增值收益权,对缓解人地冲突、完善农民的社会保障权及促进理性政府的形成具有重要的理论价值和现实意义。
The current collective land value-added profit shall be owned by the state of the system,which seriously harms the land-interests of farmers. Pursuit of the land-interests from the current land expropriation system and the governments at all levels has impacts the realization of farmers＇ land value-added profit. To achieve the land rights of farmers, it has to construct farmers and countries to share the land value-added income right of benefit sharing mechanism, to appreciate the reconstruction of collective land value-added profit. Reconstruction of collective land value-added profit, can alleviate human conflict, improve the social security right of farmers and promote has important theoretical value and practical significance to form the rational government.
