摘要
《民事诉讼法》第133条第1项规定的诉讼程序向督促程序转换机制,其立法旨趣在于,使符合督促程序适用条件的案件,尽量以督促程序解决,避免以诉讼程序处理此类案件所造成的不经济。然而,该机制在实务中极少适用,很大程度上偏离了立法的预设目标,其程序转换的顺序亦违背民事诉讼的审判逻辑,并且因欠缺具体的制度设计而存在难以克服的运行障碍。整体而言,诉讼程序向督促程序转换机制属于欠缺基本原理支撑的"政策性"程序改革。为促成"遵循司法规律推进繁简分流"之落实,可重新解读第133条第1项的规定,将"转入督促程序"的时间节点提前至立案环节;同时,可借鉴舍弃、认诺制度及简易判决制度,扩充没有实质争议案件的解决途径。
The Article 133(1)of Civil Procedure Law establishes the transformation from litigation procedure to procedure for a payment order.The legislative purpose of the transformation is to urge cases which are found to be suitable for applying order of payment being solved by the procedure for a payment order as far as possible,and avoid the diseconomy caused by dealing with such cases through litigation procedure.However,the transformation is rarely applied in practice,largely deviating from the legislative purpose.Moreover,it is also contrary to the trial logic of civil litigation and is difficult to overcome obstacles in implementation due to the lack of specific institutional design.Generally speaking,the transformation from litigation procedure to procedure for a payment order departs from current civil procedural theories.In order to promote the diversion of cases according to the judicial law,the transformation of Article 133(1)should be happening in the stage of prosecution and acceptance,and it is necessary to draw lessons from the systems of abandoning claims and admitting claims,or system of summary judgment to expand the solution of cases without substantive dispute.
