摘要
我国城市化过程中失地农民面临财产权、生存权、参与权、知情权、就业权和社会保障权等权益受到侵犯的情形,这与我国长期实行的城乡二元经济体制、官员考核机制、集体土地产权主体不明、征地程序不透明以及权利救济制度不通顺等制度性缺陷有密切关系。因此,改革农村集体土地交易制度、明晰其产权主体、征地程序公开透明化和完善纠纷救济制度是保护失地农民权益的重要举措。同时,政府还应为失地农民提供与城市居民平等的劳动就业机会和社会保障服务公共产品。
In the process of urbanization, the land-lost farmers in China are faced with infringements onproperty rights, right to life, participation, right to know, employment rights and social security, which areclosely related to some institutional defects, such as long-terra urban and rural dual economic system, thequalification assessment for officials, the unknown collective land ownership, non- transparent landexpropriation procedure and unsmooth rights relief system. Therefore, the important measure to protect therights and interests of land-lost farmers relies on the solutions to the reform of the rural collective subject of landtransaction system, the clear the property rights, the land expropriation procedure transparency and the perfectsystem of dispute relief. At the same time, the government should also provide the equal employmentopportunity and social security service public products for land-lost farmers and urban residents.
