摘要
我国非法证据排除证明机制运行的程序环境存在程序空间封闭、程序结构压制、程序结果草率等问题,动议主体的无效性、裁判主体的偏向性、证明责任主体的不当性是排除非法证据的相关主体方面存在的问题,非法证据排除证明标准在证据范围、证明要求、衡量尺度、证明方法等方面存在问题;中共十八届四中全会提出的"推进以审判为中心的诉讼制度改革"的主张为非法证据排除证明机制的改革提供了诉讼法理依据;以此为基础,我国非法证据排除证明机制需要从程序、主体、证明责任、证明标准和证明方法几方面进行改革,侦查、审查起诉阶段需要建立以审判职能为中心的审查机制,辩护方的证明责任需要进一步降低,证明标准需要进一步细化,证明方法需要进一步体现法治理念。
The main problems with the settings for the operation of China＇ s testimony mechanism of illegal evidence exclusion include procedural space closing, procedural structure suppression and perfunctory procedural outcomes. The main problems with the relevant subjects for the exclusion of illegal evidences involve the inefficiency of motion subjects, the partiality of trial subjects and the inappropriateness of testimony subjects. The main problems with the testimony criteria for the exclusion of illegal evidences cover the scope of evidences, the requirements of testimony, the yardsticks of measurement and the methods of testimony. The 4th Plenary Session of the Communist Party of China proposed ＂reform of litigation system centered on trials＂, which becomes the jurisprudence basis for the reform 3f the testimony mechanism of illegal evidence exclusion. It is argued that this reform should proceed from the perspectives of procedures, subjects, testimony criteria and testimony methods, and that in the stages of investigation, examination and prosecution an examination mechanism centered on the examination functions should be established, the estimony liabilities of defendants should be further reduced, the testimony criteria should ）e further detailed and the testimony methods should better demonstrate the notions of aw.
