摘要
既有的政府法律顾问不具有独立的主体地位,一般只能以代理人或代表人的身份开展工作,甚至在很多情况下无需显示身份。这种无地位、无组织的状态已经不能满足现实需要,"普遍建立法律顾问制度"内在地要求赋予政府法律顾问以相应的主体地位,并通过组织化建设使主体地位在名义上得到体现,最终实现提高管理效率的目标。
Government legal advisors don＇t have the independent status as legal subjects and can only work as agents or representatives, or even show no identities in many cases. As the non-status and unorganized state can not meet the real needs, ＂universally establishing the system of legal advisor＂ proposed by the Central Committee of CPC in a decision inherently requires that status as legal subjects be given to government legal advisers, reflect the status through construction of organizations, and ultimately realizing the goal of improving management efficiency.
