摘要
当前,"应召专车"成为客运市场的一种新型模式,但从行政法律角度分析,其所涉车辆应属营运车辆,所提供服务应属客运合同,在我国实行的营运车辆与非营运车辆严格区分的法律框架下,其行为属于不符合相关规定。但是,"应召专车"的出现源自于现有行业管理的僵化,是在市场需求下经济主体自身催生的创新。在尊重市场规律、简政放权的大背景下,对于这种新型客运业态的行政规制应当被正确引导和规范,并通过扩大汽车租赁的服务范围、简化租赁手续等方式,在特定时间特定区域将应召专车作为现有供给严重不足的客运市场的一种补充,从而实现社会、行业和个人的"多赢"。
Currently, the 'for-hire vehicle' becomes a new model of passenger transport market, but in view of administrative law, it is not consistent with relevant provisions under the legal framework of strict distinguish between commercial vehicles and non-commercial vehicles in China for the vehicles used being commercial ones whilst the service related being the passenger transport contract. Nevertheless, since the fossilization of the current industrial management, the birth of this 'for-hire vehicle' is the innovation by the economic subject its own under the market requirement. So under the grand background of market regulation respect and decentralization, correct guidance and standards should be given to this new passenger transport format such as expanding the service range of auto leasing and simplifying leasing procedures, etc. to make this ‘for-hire vehicle' a supplement to the existing passenger transport market which is seriously short of supply at a specific time and in a specific area, in order to achieve the multi-win among the society, the industry and individuals.
