摘要
消费者安全权是电子商务环境下消费者最重要的一项权利,也是亟待解决的一个主要矛盾。安全的网络环境和健全的法律制度是电子商务环境下消费者安全权最有力的保证。第一,制定电子商务消费者权益保护法,给予网络消费者合理的冷确期,赋予网络消费者以反悔权和撤销权,对不良商家进行惩罚性赔偿;第二,健全电子商务监管体制,建立网络交易经营者市场准入制度;第三,建立电子商务保障金制度,对电子商务商家的资质、信誉、规模和经营状况进行评估,按比例提取一定的电子商务保障金;第四,明确诉讼管辖权,如采取约定管辖原则、被告人所在地管辖原则、电子合同履行地管辖原则等,保护消费者通过司法渠道维权;第五,健全和发展在线投诉、在线纠纷解决、在线网络信任评估、在线网络信息共享等机构,拓宽消费者安全权法律救济途径。
Consumers' safety right is the most important right of consumers under the background of E-business;it is also the important conflict. The safe network environment and perfect law system is the most powerful guarantee of consumers' safety under the background of E-business. First,we should formulate the related law,provide online consumers with rational coolingoff period,empower online consumers to have the right to regret and withdraw,and force the unethical merchants to be punished;second,we should formulate the market access mechanism and perfect the related supervision system;third,we should formulate the guarantee system,carry out the evaluation on E- businesses' qualification,credit reputation,scale and operational situation,and proportional withdraw some money for guarantee;fourth,we should clarify the jurisdiction of lawsuit,and encourage consumers to safeguard their rights through judicial channel;and fifth,we should perfect and develop the online complaining,online disputes resolution,online evaluation,and online network information sharing agents and expand more legal remedy ways for consumers.
