摘要
维护职工合法权益是中国工会的重要职能。改革开放以来,中国工会维护职能的演变过程经历了三个阶段,即改革之初以保障职工生存为基本特征、《劳动法》颁布后维护职能的多样化发展、进入新世纪后维护职能的制度化发展。在这一演变过程中,工会维护工人权益的力度、强度和广度不断扩展。今后,应不断提升工会维权制度的有效性,进一步明确工会的职能定位,从而真正成为工人利益的代表者和维护者。
Protecting the lawful rights and interests of workers is an important function of Chinese Trade union.Since the reform and opening- up,there are three stages in the evolution process of Chinese trade union’s protection function.The first is the stage of protecting workers’ survival at the beginning of reform;the second is the stage of protection function’s diversification development after "Labor Law" was promulgated;and the third is the stage of protection function’s institutionalization development after entering the new century.In this evolution process,the strength,intensity and breadth of trade union’s protecting workers’ rights and interests are continuously expanding.For the future,trade union’s protection institutions should be given more effectiveness and its function should be further clarified,so trade union can become the real representative and protector of workers’ interests.
