摘要
我国自建国以来一直将行政、事业单位所占有使用的财产视为国有。为便于管理,遂对其实行了中央与各级地方分级管理的体制,但各级地方对其直接管理的行政事业性财产往往享有了所有者利益而直接成为了利益主体,因此中央与地方之间势必存在利益冲突。尽管适用我国国有财产的分级代表理论能够在一定程度上缓解二者之间的利益冲突,但却无法解决国有与各级地方实际处于所有者之间的矛盾,与其这样,不如在借鉴中央与地方之间对国有财产分别享有权的分权理念下,直接赋予各级地方行政事业性财产所有权。即,中央直接占有使用的行政事业性财产应为国有,各级地方直接占有使用的行政事业性财产应为各级地方所有,典型的就是现实生活中大量存在的教育性财产也就相应地被确定为国有与地方所有。

Although state-owned property in our country under the premise of the classifica- tion of representative theory, to a certain extent, ease the conflicts between them, but it cannot solve state and local actual in the contradiction between the owner, and such, in reference to the state- owned property between central and local decentralization under the idea of not directly give local di- rectly to their right to ownership, of course, the central direct possession of the administrative units and non-profit organizations property because of using the state-owned and local direct possession of the administrative units and non-profit organizations property of use should be local owned, there is in real life, a large number of typical educational property is identified for all state and local.
