摘要
著作权财产保护期在各国著作权法的制定和修改中是一个重要的概念。TPP协议官方文本概要中将自然人作品著作财产权保护期延长至70年,美国在版权产业发达的基础上将"70年"作为TPP协议中的最低保护标准以实现其版权扩张战略。根据对中国版权产业的数据研究,我国还不是知识产权强国,保留必要的公共领域是著作权法立法宗旨,我国不必急于延长著作财产权保护期。
The duration of property rights is an important concept in enacting and modifying copyright law in many countries. The official summary provisions of TPP（ Trans-Pacific Partnership） extend the term of property rights in copyright law to 70 years. The United States attempts to implement the strategy of expanding domestic copyright industry via formulating 70 years as the elementary protecting standard in TPP. According to the data of Chinese copyright industry,it is unnecessary to extend the duration of property rights in Chinese copyright law,for China is not yet a powerful country in copyright industry. Therefore,there is still necessity to maintain public field and interest in copyright law in China.
